终身禁驾要怎么处理才能解除

释义

法律主观：

终身禁驾不能能解除。终身禁驾，即被吊销机动车驾驶证且终生不得重新取得机动车驾驶证。我国现行的法律中还没有关于解除终生禁驾的方法和规定，如果对处罚决定不服可以申请行政复议。终生禁驾的原因主要有两种：一是饮酒后或者醉酒驾驶机动车造成重大交通事故，构成犯罪。二是造成交通事故后逃逸，构成犯罪。

法律客观：

《中华人民共和国道路交通安全法》第九十一条第五款饮酒后或者醉酒驾驶机动车发生重大交通事故，终生不得重新取得机动车驾驶证。
