释义	法律分析：夫妻一方掉进河另一方不救死亡属于间接不作为是违法的。夫妻间相互负有义务，虽然在我国现行法律中，只有民法典规定了夫妻间有相互扶养的义务。法律没有明文规定夫妻间负有相互救助的义务。但是夫妻另一方有能力、有条件实施救助义务，在行为人不履行抢救义务的这种情况下，造成夫妻一方的死亡后果，人民法院追究行为人的刑事责任，以故意杀人罪判处。法律依据：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑;情节较轻的，处三年以上十年以下有期徒刑。
