释义	婚外情第三者并不违法。第三者应当接受道德舆论的谴责，接受道德法庭的审判，依照我国现行法律的规定，第三者无需承担任何法律上的责任。夫妻双方因一方婚外情离婚的，有婚外情的一方属于过错方，无过错方有权向其请求损害赔偿。【法律依据】根据2021年1月1日生效的《民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
