法律主观：

直系亲属中不包括兄弟姐妹，兄弟姐妹属于近亲属。直系亲属指和自己有直接血缘关系或婚姻关系的人，如指配偶、父母、子女、祖父母、外祖父母、孙子女和外孙子女。因此兄弟姐妹不属于直系亲属，但因为有血缘关系，故属于近亲属。
