问题	诉讼中的期间的计算
释义	不论刑事、民事，都不包括在途期间，即不应将在旅途中所消耗的时间计入法定或指定期限之内。在期满前将诉讼文书交邮的，不算过期。中国《民事诉讼法（试行）》规定，期间届满的最后一日是节假日的，以节假日后的第一日为期间届满的日期。
