释义	法律分析：过错责任原则也叫过失责任原则，它是以行为人主观上的过错为承担民事责任的基本条件的认定责任的准则。按过错责任原则，行为人仅在有过错的情况下，才承担民事责任。没有过错，就不承担民事责任。法律依据：《中华人民共和国民法典》第一百零六条第二款当我国公民或者法人有侵犯国家的、集体的利益时，或者是侵犯他人的人身财产安全时，就算该公民或者法人是因为过失，也应当承担相应的民事责任。
