释义	法律分析：第三人与无权代理人是否构成恶意串通,按我国《民法典》第一百六十四、第一百五十四条的规定,恶意串通损害第三人利益的行为无效,且第三人与无权代理人就本人之损害承担连带责任。所谓串通,传统民法称之为“通谋”,即双方故意的意思与表示不一致。法律依据：《中华人民共和国民法典》第一百六十四条代理人不履行或者不完全履行职责，造成被代理人损害的，应当承担民事责任。代理人和相对人恶意串通，损害被代理人合法权益的，代理人和相对人应当承担连带责任。
