法定假日学校不放假违法吗 |

不算违法，但违规。学生不是劳动者，不受《劳动合同法》调整，教师可以算加班工资，学校不支付，可以向劳动局投诉。全体公民放假的假日，如果适逢星期六、星期日，应当在工作日补假。部分公民放假的假日，如果适逢星期六、星期日，则不补假。学生也属于中华人民共和国公民，所以学校不放假可以向当地教育主管机构投诉。
（1)向本地的人民代表大会常务委员会体现并下书面形式整改报告规定院校变更放假安排;
（2)联络本地教育局，请教育部门宣布的对大学的方式给予改正;
（3)立即和校园的领导干部商讨规定变更，假如院校心态蛮横无理，可以挑选极端化，把谈话内容音频后检举到检察系统，以院校不听学员建议及其私自变更国家法定假日公假时间为由规定定期检查人民法院给予行政处罚法。
整体中国公民放假的传统节日：
(一)元旦节，放假1天(每一年1月1日)
(二)新春佳节，放假3天(正月初一、初二、初三)
(三)清明时节，放假1天(阴历清明节当天)
(四)五一劳动节，放假1天(5月1日)
(五)端午佳节，放假1天(阴历端午节当天)
(六)中秋佳节，放假1天(阴历中秋节当天)
(七)十一国庆，放假3天(10月1日、2日、3日)。
【法律依据】：《全国年节及纪念日放假办法》第六条：全体公民放假的假日，如果适逢星期六、星期日，应当在工作日补假。部分公民放假的假日，如果适逢星期六、星期日，则不补假。
