释义	拾得遗失物构成非法侵占，属民法上的不当得利行为，公安机关是无权管辖的，但是一般会告知需要返还。如果不返还可能会被起诉。如果将捡到的手机占为已有，拒不归还，且数额较大的，则构成侵占罪，要承担刑事责任。法律依据：《刑法》第二百七十条：将代为保管的他人财物非法占为己有，数额较大，拒不退还的，处二年以下有期徒刑、拘役或者罚金；数额巨大或者有其他严重情节的，处二年以上五年以下有期徒刑，并处罚金。将他人的遗忘物或者埋藏物非法占为己有，数额较大，拒不交出的，依照前款的规定处罚。
