释义	法律分析：不录用不能跟着感觉，得建立在公正、客观的基础之上。用人单位如果认为劳动者不符合录用条件并解除劳动合同的,有举证义务。即用人单位必须证明其已将录用条件明确告知了劳动者,并根据录用条件对劳动者进行了考核相应证据证明劳动者不能达到录用条件将考核结果告知了劳动者劳动者不符合录用条件、与其解除劳动合同的决定送达了劳动者等。法律依据：《中华人民共和国劳动合同法》第三十九条劳动者在试用期间被证明不符合录用条件的，用人单位可以解除劳动合同，且无需支付经济补偿。
