释义	法律分析：上补习班不会违法的，没有规定学生上补课班违法，那是个人的自由，只是不允许在校的老师给学生进行有偿补课。法律依据：《中华人民共和国教育法》第七十六条学校或者其他教育机构违反国家有关规定招收学生的，由教育行政部门或者其他有关行政部门责令退回招收的学生，退还所收费用学校、其他教育机构给予警告，可以处违法所得五倍以下罚款节严重的，责令停止相关招生资格一年以上三年以下，直至撤销招生资格、吊销办学许可证直接负责的主管人员和其他直接责任人员，依法给予处分成犯罪的，依法追究刑事责任。
