释义	遗弃罪概念是负有扶养义务的人，对年老、年幼、患病或者其他没有独立生活能力的人拒绝抚养，情节恶劣的行为。情节恶劣的，处五年以下有期徒刑、拘役或者管制。【法律依据】《刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
