释义	法律分析: 双重租赁中承租人是: （一）双方均未对租赁房屋实际占有的，租赁房屋归已经办理登记备案手续的承租人；（二）一方已经合法占有租赁房屋的，赁房屋归对租赁房屋实际占有的承租人。法律依据:《《商品房屋租赁管理办法》》第十四条房屋租赁合同订立后三十日内，房屋租赁当事人应当到租赁房屋所在地直辖市、市、县人民政府建设（房地产）主管部门办理房屋租赁登记备案。房屋租赁当事人可以书面委托他人办理房屋租赁登记备案。
