释义	【法律意见】盗窃帐号的行为属于违法行为，随便盗取别人号属于侵权行为，不直接犯法吗，也不会坐牢。如果通过盗取号，实施诈骗行为，如果诈骗超过3000元至10000元以上就涉嫌诈骗罪，应当判处有期徒刑，判实刑就会坐牢的。【法律依据】《关于维护互联网安全的决定》第四条第（二）项规定：“非法截获、篡改、删除他人电子邮件或者其他数据资料，侵犯公民通信自由和通信秘密的，依照刑法有关规定追究刑事责任。”
