释义	法律分析：1、合同中有关于面积误差的约定时，不管该约定的面积误差是否在3%以内还是以外，均应依合同约定的面积误差处理方式处理。 2、合同中没有关于面积误差的约定，则应参照《商品房销售管理办法》的规定予以处理。 3、合同中有“按竣工后实际面积计算”的条款，则应看竣工后面积改变的大小是否在一般建筑面积应有的误差范围之内。法律依据：《商品房销售管理办法》第二十条按套内建筑面积或者建筑面积计价的，当事人应当在合同中载明合同约定面积与产权登记面积发生误差的处理方式。
