释义	法律分析：是全国通用。自受伤之日起30天内，用人单位向劳动局提出工伤认定申请，用人单位没在30天内提出工伤申请认定工作的，伤者或家属可以在一年内向劳动局提出工伤认定申请。法律依据：《工伤保险条例》第二十一条职工发生工伤，经治疗伤情相对稳定后存在残疾、影响劳动能力的，应当进行劳动能力鉴定。　第二十三条劳动能力鉴定由用人单位、工伤职工或者其近亲属向设区的市级劳动能力鉴定委员会提出申请，并提供工伤认定决定和职工工伤医疗的有关资料。
