法律分析：一般情况下，胎儿是不具有民事权利主体资格的，胎儿出生之后才具有民事权利能力，但根据我国相关法律规定，在遗产继承、接受赠与等方面，未出生胎儿视为具有民事权利能力，其权利也将受到法律的保护，就算是胎儿也要保障他的权益。
法律依据：《中华人民共和国民法典》 第十六条 涉及遗产继承、接受赠与等胎儿利益保护的，胎儿视为具有民事权利能力。但是，胎儿娩出时为死体的，其民事权利能力自始不存在。
