释义	1．侵犯的客体是国家的信用卡管理制度。 2．犯罪的客观方面表现为妨害信用卡管理的行为。具体包括四种情形：（1）明知是伪造的信用卡而持有、运输的，或者明知是伪造的空白信用卡而持有、运输，数量较大的（2）非法持有他人信用卡，数量较大的（3）使用虚假的身份证明骗领信用卡的（4）出售、购买、为他人提供伪造的信用卡或者以虚假的身份证明骗领信用卡的。 3．犯罪主体是一般主体。单位不能成为本罪的主体。 4．犯罪的主观方面表现为故意，并且一般均具有牟取非法利益的目的。
