释义	法律分析：遗忘物和遗失物的区别： 1、遗忘物是遗忘人意识地将自己持有的财物放在某处，因为一时疏忽而忘记拿走而暂时失去控制的财物。遗失物则是偶然将某物失落在某处，以至脱离自己的控制。 2、我国刑法只规定侵占遗忘物，而未规定侵占遗失物，也就是说侵占罪只能是侵占遗忘物而与拾到遗失物拒不归还只能追究其民事责任。法律依据《中华人民共和国民法典》第三百一十四条拾得遗失物，应当返还权利人。拾得人应当及时通知权利人领取，或者送交公安等有关部门。
