释义	无作为义务的见死不救在刑法中一般不构成犯罪，不予处罚；但对于有作为义务的见死不救，可以视为故意杀人罪定罪处罚。故意杀人罪是指故意非法剥夺他人生命的行为，犯本罪的处死刑、无期徒刑或者10年以上有期徒刑，情节严重的应当判处死刑或者无期徒刑。【法律依据】《刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。第二百三十三条过失致人死亡的，处三年以上七年以下有期徒刑；情节较轻的，处三年以下有期徒刑。本法另有规定的，依照规定。
