释义	法律分析：案例可以作为参考，但是不能作为判决的依据。我国法律明确规定，人民法院审理民事案件，必须以事实为根据，以法律为准绳，人民法院在对民事案件作出判决时，存在疑虑的，可以参考同类型的案例，但是不能依据同类案件进行判决，因为我国不实行判例法，不能依据以往的案例进行判决，必须依据案件事实和法律进行判决。法律依据：《中华人民共和国民事诉讼法》第七条人民法院审理民事案件，必须以事实为根据，以法律为准绳。
