释义	根据《国务院关于第三批取消和调整行政审批项目的决定》（国发〔2004〕16号）的规定，已取消民政部门对生产、销售丧葬用品的前置审批，可凭市场监督管理部门办理的营业执照，从事丧葬用品的销售，但应遵守国务院《殡葬管理条例》第十七条“禁止制造、销售封建迷信的丧葬用品。禁止在实行火葬的地区出售棺材等土葬用品”等有关规定。【本文关联的相关法律依据】《中华人民共和国宪法》第五十三条中华人民共和国公民必须遵守宪法和法律，保守国家秘密，爱护公共财产，遵守劳动纪律，遵守公共秩序，尊重社会公德。
