能不能去新单位入职，一般要看新单位对入职是否有明确要求。目前许多单位都会明确要求提供与原单位解除劳动合同的证明(离职证明)才能办理入职手续。根据劳动法和劳动合同法的规定，与用人单位解除劳动关系，用人单位应当办理离职手续，出具离职证明，但并未要求必须签署解除劳动合同的书面文件。员工提前三十天通知用人单位，三十天后即发生解除劳动关系的法律效力。如果有正式离职文件，应以文件记载日期为离职日期。

《中华人民共和国劳动合同法》
第三十七条 劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
第三十九条 劳动者有下列情形之一的，用人单位可以解除劳动合同：
(一)、在试用期间被证明不符合录用条件的(二)、严重违反用人单位的规章制度的(三)、严重失职，营私舞弊，给用人单位造成重大损害的(四)、劳动者同时与其他用人单位建立劳动关系，对完成本单位的工作任务造成严重影响，或者经用人单位提出，拒不改正的(五)、因本法第二十六条第一款第一项规定的情形致使劳动合同无效的(六)、被依法追究刑事责任的。
