法律分析：
陌生人见死不救不犯法，看到陌生人落水却没有施救，因为两者之间没有间接关系，因此没有义务必须施救，也就不会获罪，对于个别人只看热闹不施救，虽然法律不能惩罚，但应该受到道德谴责。如果死者与见死不救者有关系，此人就有义务对对方进行施救；这种情况下如果不救导致死亡，见死不救者就会判故意杀人。
法律依据：
《中华人民共和国刑法》 第二百三十二条 故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
