释义	《北京市高级人民法院关于审理医疗损害赔偿纠纷案件若干问题的意见(试行)》第二十五条：有下列情形之一，医疗机构能够将患者的病情、医疗措施、医疗风险告知患者或其家属并取得其同意而未告知的，应认定医疗机构违反了告知义务： (1) 对患者施行手术; (2) 对患者施行特殊检查或特殊治疗; (3) 对患者施行实验性临床检查和治疗; (4) 对患者施行其他可能产生严重不良后果的诊断、治疗活动。
