法律分析:劳动合同中约定工资经双方确定,只要不低于当地最低工资就是合法的,劳动合同约定工资低于实发工资的情况,用人单位可以少缴纳五险一金,通常绩效考核等每月变化的报酬是不包含在五险一金的基数里面的。所以具体还是看当地的平均工资。
法律依据:《中华人民共和国劳动法》 第四十六条 工资分配应当遵循按劳分配原则,实行同工同酬。
