《使用有毒物品作业场所劳动保护条例》第六十四条 违反本条例的规定，未经许可，擅自从事使用有毒物品作业的，由工商行政管理部门、卫生行政部门依据各自职权予以取缔；造成职业中毒事故的，依照刑法关于危险物品肇事罪或者其他罪的规定，依法追究刑事责任；尚不够刑事处罚的，由卫生行政部门没收经营所得，并处经营所得3倍以上5倍以下的罚款；对劳动者造成人身伤害的，依法承担赔偿责任。
