释义	公办学校，教育经费由政府财政划拨，是不能再收取餐费。民办的话，民办公助只要交住宿费和餐费，但我国义务教育法并没有明确指出民办学校必须交餐费。这完全是学生自愿，学校无权干涉。法律依据《义务教育》第五十四条有下列情形之一的，由上级人民政府或者上级人民政府教育行政部门、财政部门、价格行政部门和审计机关根据职责分工责令限期改正： (一)侵占、挪用义务教育经费的; (二)向学校非法收取或者摊派费用的。
