释义	法律分析：口头遗嘱是立遗嘱人口头表述的遗嘱。订立口头遗嘱必须符合二个条件： 1、须在危急情况下才可以使用此种形式； 2、需要两个以上见证人在场见证。这两个条件是口头遗嘱成立并且有效的必备条件，缺一不可。而且需要注意一点，立口头遗嘱，在危急情况解除后，遗嘱人能够用书面或者录音形式立遗嘱的；先前所立的口头遗嘱归于无效，应该及时另立遗嘱，否则，之前订立的口头遗嘱将成为无效遗嘱。法律依据：《中华人民共和国民法典》第一千一百三十九条公证遗嘱由遗嘱人经公证机构办理。
