第三十八条 民兵是不脱产的群众武装组织，是中国人民解放军的助手和后备力量。
第三十九条 乡、民族乡、镇、街道和企业事业单位建立民兵组织。凡十八周岁至三十五周岁符合服兵役条件的男性公民，经所在地人民政府兵役机关确定编入民兵组织的，应当参加民兵组织。
