释义	法律分析：根据我国行政诉讼法，除非法律、法规规定必须先申请行政复议的，行政争议当事人可以自由选择申请行政复议还是提起行政诉讼。行政复议已经被依法受理的，当事人在法定复议期限以内不得提起诉讼；行政诉讼已经被依法受理的，则不得再申请行政复议。法律依据：《中华人民共和国行政复议法》第九条公民、法人或者其他组织认为具体行政行为侵犯其合法权益的，可以自知道该具体行政行为之日起六十日内提出行政复议申请；但是法律规定的申请期限超过六十日的除外。
