释义	德国于19世纪的宪政思潮运动之中，已将把废除死刑视为文明开化的符号象征，1848、49年左右，德国部分邦国已废除死刑，如不来梅、奥登堡、萨克森。 1870年，北德意志邦联成立，国会首度讨论刑法中死刑存废的问题，在反对死刑的威廉·李卜克内西的演讲后，二读81至118票同意取消，但在俾斯麦呼吁下，仍将死刑保留于刑法中，在三读时，119至127同意保留。法律依据:德国《基本法》第一百零二条死刑应被取消。
