释义	法律分析：合同成立是指合同当事人就合同条款达成协议。合同的成立应当符合下列条件： 1、订单主体有双方或多方当事人法人； 2、双方必须依法订立合同； 3、双方必须就合同的主要条款达成一致； 4、合同的成立应当具有要约和承诺阶段。不符合上述要求的，合同不成立，根据《中华人民共和国民法典》的规定承诺生效时成立合同。法律依据：《中华人民共和国民法典》第四百八十三条承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。
