释义	法律分析: 过失和过错的区别为：概念不同，构成要件不同，过失是应当预见自己的行为可能发生危害社会的结果，因为疏忽大意而没有预见，或者已经预见而轻信能够避免，以致发生这种结果的心理态度；过错是指当事人通过其实施的侵权行为所表现出来的在法律和道德上应受非难的故意和过失状态。《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
