释义	法律分析: 劫持汽车罪一般不包括出租车。如果行为人没有使用暴力、胁迫和其他方法，或者没有劫持汽车，或者劫持的不是汽车的，都不构成本罪。以暴力、胁迫或者其他方法劫持船只、汽车的，处五年以上十年以下有期徒刑；造成严重后果的，处十年以上有期徒刑或者无期徒刑。《中华人民共和国刑法》第一百二十二条以暴力、胁迫或者其他方法劫持船只、汽车的，处五年以上十年以下有期徒刑；造成严重后果的，处十年以上有期徒刑或者无期徒刑。
