释义	律师分析： “故意杀人”是指故意非法剥夺他人生命的行为。属于侵犯公民人身民主权利罪的一种。是中国刑法中少数性质最恶劣的犯罪行为之一。 "激情杀人"仅是作为刑事侦查术语，来描述犯罪过程。法庭辩护中，不能据此作为免责事由。同时我国刑法中没有对该词定义，从法理角度只是用来分析杀人者的主观动机和主观恶性，而不是准确的罪名。【法律依据】：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
