释义	起诉书是人民检察院依照法定的诉讼程序，代表国家向人民法院对被告人提起公诉的法律文书。因为它是以公诉人的身份提出的，因此呢也叫公诉书。起诉状是指公民、法人或者其他组织为了向人民法院起诉而递交的法律文书。最大的区别在于出具的主体不一样。起诉书一般是国家机关出具，起诉状一般是当事人出具。法律依据：《中华人民共和国民事诉讼法法》第一百二十条：应当向人民法院递交起诉状，并按照被告人数提出副本。书写起诉状确有困难的，可以口头起诉，由人民法院记入笔录，并告知对方当事人。
