释义	法律分析: 有效，按照最高法院的规定，民间借贷的利息可适当高于银行利率，但最高不得超过同期银行贷款利率的4倍，超出部分的利息法律不予保护，每日千分之三并没有超过四倍，但最好是约定为利息而不要约定为滞纳金。法律依据: 《中华人民共和国民法典》第六百七十六条借款人未按照约定的期限返还借款的，应当按照约定或者国家有关规定支付逾期利息。
