释义	律师分析: 一是超过要约规定的承诺期限作出，因而出现了迟延，二是在要约规定的承诺期限内作出，但由于邮政等其他原因，没有及时到达要约人。第一种情况，由于承诺本应在承诺期限内作出，超过有效的承诺期限，要约已经失效。【法律依据】: 《中华人民共和国民法典》第四百八十一条承诺应当在要约确定的期限内到达要约人。要约没有确定承诺期限的，承诺应当依照下列规定到达：（一）要约以对话方式作出的，应当即时作出承诺；（二）要约以非对话方式作出的，承诺应当在合理期限内到达。
