释义	法律分析：如果用人单位没有与劳动者约定底薪，是不合法的，没有与劳动者签订劳动合同，劳动者可以要求用人单位支付双倍工资差额，对于用人单位无故克扣工资的行为，劳动者可以向当地的劳动部门投诉或者申请劳动仲裁。法律依据：《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。
