释义	法律分析：事实劳动关系是指用人单位与劳动者在履行劳动权利和义务时一种既成事实，客观存在的劳动关系，大体有以下几种形式：（一）应签订而未签订劳动合同；（二）以口头问答代替书面合同；（三）以其他合同代替劳动合同，如在租赁合同，承包合同等。法律依据：《中华人民共和国劳动法》第二十条劳动者在同一用人单位连续工作满十年以上，当事人双方同意续延劳动合同的，如果劳动者提出订立无固定期限的劳动合同，应当订立无固定期限的劳动合同。
