法律分析：醉驾入刑的立法原意是将醉驾行为列入犯罪进行打击，以保护醉驾者自身和无辜路人的生命。但醉驾入刑以来，醉驾型危险驾驶罪案件数量不仅没有减少，反而不断攀升，目前已高居刑事案件数量首位。
法律依据：《中华人民共和国刑法》第一百三十三条之一的规定，触犯危险驾驶罪的刑罚是拘役，并处罚金。仅剥夺数个月的自由、若罚金刑判罚数额较低，对被告人的惩罚与警示不足，影响刑罚效果的发挥。刑法真正需要遏制、打击的是深度醉驾后驾车的行为。
