释义	如果明知对方已婚，还以夫妻名义同居，涉嫌重婚罪，触犯了刑法。重婚罪有两种情形：一是，有配偶者又与他人登记结婚，或者明知他人有配偶而与之登记结婚；二是，有配偶者与他人以夫妻名义同居生活，或者明知他人有配偶而与之以夫妻名义同居生活。也就是，同居者即使没有登记结婚，也存在成立事实婚姻的可能。法律依据：《刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
