补休和调休有什么区别 |

法律分析：一、补休，顾名思义，是弥补休息时间的意思。是指该休息而未休时，事后用其它时间来弥补之前该休而未休的时间。“补休”是用来弥补劳动者在休息日正常工作而失去的休息时间。补休时间应等同于加班时间。二、调休，从文义解释看，是调整休息时间的意思。从我国现行规定看，国务院有权调整全民的休息时间，企业有权调整企业内部的休息时间。所谓的“调休”是指将某个特定的公休日调到其它时间(一般是往后调)。这和“补休”性质是不一样的，“补休”是在工作日进行休息弥补之前的公休日的加班时间，公休日的日期并未发生变化。而“调休”是国家利用公权力直接改变了公休日的日期，将一个不属公休日的日期直接改为公休日。
法律依据：《中华人民共和国劳动法》第四十四条有下列情形之一的，用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬：(一)安排劳动者延长工作时间的，支付不低于工资的百分之一百五十的工资报酬;(二)休息日安排劳动者工作又不能安排补休的，支付不低于工资的百分之二百的工资报酬;(三)法定休假日安排劳动者工作的，支付不低于工资的百分之三百的工资报酬。
