释义	广义上的劳务合同是包括承揽合同的，狭义上的劳务合同仅指雇佣合同;而雇佣合同与承揽合同的分别在于： 1、合同双方在从事劳务活动中的地位与关系;前者是支配和从属，后者是相互独立的; 2、计酬依据和形式：前者计酬依据是劳务本身，后者依据则是劳动成果; 3、对劳务提供者的亲历性要求不同。《民法典》第七百七十条：承揽合同是承揽人按照定作人的要求完成工作,交付工作成果,定作人支付报酬的合同。承揽包括加工、定作、修理、复制、测试、检验等工作。
