拘留所超期关押10天的维权主要是可以申请获得国家赔偿，虽然我国的司法机关，是由权利去关押那些可能犯罪的主体的，但是必须要有充足的证据之后才会被批捕，而对于一切没有批捕的情形，关押都是有期限的，不得超期关押。
被警察带去协助调查一般会关二十四小时之内，会通知家人。如果是单单的协助调查，没有违法犯罪，是24小时的时间，但是公安机关的协助调查，例如刑警队，经侦队，禁毒队这些所说的协助调查，基本都是违法犯罪嫌疑人，在经过48小时的调查后，大部门都是转送到看守所了。
监狱发现罪犯关押超期怎么办?
监狱发现罪犯关押超期的情况下，应当与当事人的亲属联系，并做好出狱工作。看守所是关押未决犯的地方，也就是说法院的判决书下达且该判决书生效前，犯人均是关在看守所的。犯人能被关多久，主要取决于从他被抓到法院判决书下达的时间长短。羁押期限是对待侦査、起诉、审判的人犯关押的法定时限。

传唤、拘传持续的时间不得超过十二小时;案情特别重大、复杂，需要采取拘留、逮捕措施的，传唤、拘传持续的时间不得超过二十四小时。
