释义	法律分析：工伤以后上班要看身体的状况和医生的建议。如果经过劳动能力鉴定委员会或者是医疗机构的书面证明受伤职工确实是需要继续进行休养的，则该职工可以继续在家休养。单位应该按照职工受伤情况所对应的停工留薪期去支付工资，称为误工费。但是前提条件是该职工要在劳动仲裁的时候提出来。法律依据：《工伤保险条例》第三十三条第一款职工因工作遭受事故伤害或者患职业病需要暂停工作接受工伤医疗的，在停工留薪期内，原工资福利待遇不变，由所在单位按月支付。
