释义	法律分析：如果是发回重审的案件，不可以适用简易程序。法律依据：《最高人民法院关于适用简易程序审理民事案件的若干规定》第一条基层人民法院根据《中华人民共和国民事诉讼法》第一百四十二条规定审理简单的民事案件，适用本规定，但有下列情形之一的案件除外：（一）起诉时被告下落不明的；（二）发回重审的；（三）共同诉讼中一方或者双方当事人人数众多的；（四）法律规定应当适用特别程序、审判监督程序、督促程序、公示催告程序和企业法人破产还债程序的；（五）人民法院认为不宜适用简易程序进行审理的。
