释义	法律分析：公房承租权不能继承。公有住房居住人死亡，其生前的共同居住人可以继续履行租赁合同，但前提条件是，共同居住人有本市户口且共同居住两年以上又无其他住房。如果有2人以上符合共同居住人条件的，由共同居住人协商确定承租人，到公房管理部门申请办理更名手续。法律依据：《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
