释义	法律分析：交错要约不存在合同关系，交错要约，是指当事人一方向对方发出要约，而同时对方也以同样的内容发出要约，且双方当事人彼此都不知道有要约的现象。合同成立要经过要约和承诺两个程序，在交错邀约中没有承诺阶段的，因此没有成立合同关系。法律依据：《中华人民共和国民法典》第四百八十三条承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。第四百八十四条以通知方式作出的承诺，生效的时间适用本法第一百三十七条的规定。承诺不需要通知的，根据交易习惯或者要约的要求作出承诺的行为时生效。
